Update! King Bloomberg May Not Get His Soda Ban After All

Reuters is reporting State Supreme Court Justice Milton Tingling in Manhattan has ruled the new regulation put into effect by Nanny State aficionado, Michael Bloomberg as “arbitrary and capricious.” He also declared it invalid, after the American Beverage Association and other business groups sued the city challenging the ban.

The ban was to prohibit the city’s food-service businesses from selling sugary drinks larger than 16 ounces, which more than anything else Mayor Mike has done, has given the city the moniker “Nanny State” due to the Mayor’s insistence in making decisions for the good of NYC citizens without putting the issues to a vote. The soda ban followed similar crackdowns on fat, sugar and salt and a smoking ban.

A not so small issue. Discussions of the ban led the way in debating what else could be on the table for banning without the presence of a vote. More and more New Yorkers were faced with thinking about how much governmental interference they would find acceptable based on the structure of the soda ban. In short, it became less about a gluttony issue and more about a “freedom to glutton” issue.

As we all could guess, Bloomberg will still try and ram his soda ban through since obviously he knows what’s best.
